Our terms and conditions comply with UK legislation and are designed to ensure that our customers can shop easily and with confidence with funktionevents.co.uk

1. Your Agreement with Funk:tion

To book a tour or event with Funk:tion you must place a deposit as specified by your event consultant. By placing this deposit you confirm the accuracy of all information provided and accept these terms and conditions on behalf of yourselves and anyone else in your party. The agreement between yourself and Funk:tion only comes into existence once your booking has been formally acknowledged in writing by Funk:tion. Unless you advise us to the contrary we will assume that every member is over the age of 18 years. Unless you contact Funk:tion in writing within 24 hours of receiving Funk:tion’s written acceptance, you will be deemed to have agreed to the contract terms. The terms and conditions and general information constitute the entire agreement between you and Funk:tion. It must be understood that those booking via telephone or e-mail accept our booking terms and conditions.

2. Payment to Funk:tion

All prices are in £ sterling and inclusive of VAT. If you are booking a tour or event more than 28 days before the date of the tour/ event, you must pay a deposit of £40 per person unless specified otherwise by your event consultant. Any deposit paid by you will not be refundable. The balance of the sum due must be paid at least 28 days before the date of the tour/event and if you should fail to make this payment the deposit will be retained and Funk:tion will consider the tour cancelled. If you book a tour /event within 28 days of the date of the tour, the full cost of the tour is immediately payable. All AMEX card payments will carry a 2% processing surcharge. The minimum group size is 8, this may reflect in your payment should your numbers drop below this.

3. Funk:tion Package Prices

Funk:tion reserves the right to change any of the event/ facilities or prices described in writing before the agreement between you and Funk:tion is concluded. All Price are inclusive of VAT.

4. Insurance

You are advised to take out adequate personal insurance for your protection. Such insurance should cover the cost of cancellation by you and/or any member of your party and the cost of assistance, including repatriation in the event of illness or accident. We emphasise that some of the events you may book are by their nature inherently dangerous and by participating in these you acknowledge and assume the inherent risks involved. We cannot be responsible for injury or loss suffered by you other than as expressly set out in these booking conditions. For this reason, we request that you be fully and adequately insured. Additionally, should you participate in events which do not form part of the Arrangements booked with us it should be understood that this is also at your own risk and it is your responsibility to obtain the relevant insurance. Please confirm with your Insurers that your insurance policy covers the activities you will be participating in.

5. General

Despite our suppliers being aware of the nature and likely intent of stag groups, you are expected to respect your environment and other people around you. All suppliers and hotel have every right to terminate, without notice, your stay or activity under threat of vandalism, violence or any other behaviour deemed inappropriate by them. In such cases all insurances will be invalidated and you will not have any entitlement to a refund of any kind whatsoever. We accept no liability for any accident or misadventure that occurs while any of your group is under the influence of drinks or drugs. Please also be aware that some hotels may require a behaviour 'bond' to be placed on hold with a credit card or cash, upon check in. We will do our utmost to give you prior notice where this might happen, but in some extreme cases this may not be possible. Please check with us when paying your final balance. Monies paid to us are held in a separate bank until after your booked event, in keeping with the package holidays & Tour Regulation 1992. The "term centrally located hotel" means up to a 15-20 minute walk from the designated destination city/town centre.

We always try to place groups in twin rooms where available however if these are not available you may be in triple or quad rooms

6. Our liability

1. Our agreement with you and the service we provide to you is to source and book the Arrangements for you. We promise to use all reasonable skill and care in selecting the supplier(s) who will provide your Arrangements. We have no responsibility for the provision of the actual Arrangements themselves or for the acts or omissions of the supplier(s) concerned or any of its employees, agents, suppliers or subcontractors. Please note it is your responsibility to show that all reasonable skill and care has not been used if you wish to make a claim against us. Please note: we do not exclude any liability for death or personal injury arising as a result of our negligence or that of our employees providing they were at the time acting within the course of their employment with us. Please note: Sub clauses (2) (6) below are all subject to and without prejudice to sub clause (1) above.

2. We will not be responsible for any injury, illness, death, loss (for example loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following: -

the act(s) and/or omission(s) of any person(s) affected or any member(s) of your party; or
the act(s) and/or omission(s) of a third party not connected with the provision of your Arrangements and which were unforeseeable or unavoidable; or
Force Majeure

3. Please note we cannot accept responsibility for any services which do not form part of your Arrangements. This includes, for example, any additional services or facilities which your hotel or any other supplier agrees to provide for you that we have not booked for you and any excursion you purchase during your stay. In addition, regardless of any wording used by us on our website, in any of our quotes or elsewhere, we only promise to use all reasonable skill and care as set out above and we do not have any greater or different liability to you.

4. The promises we make to you about the Arrangements we have agreed to source and book as part of our agreement - and the laws and regulations of the country in which your claim or complaint occurred - will be used as the basis for deciding whether the Arrangements in question had been properly provided. If the particular Arrangements which gave rise to the claim or complaint complied with local laws and regulations applicable to those Arrangements at the time, the Arrangements will be treated as having been properly provided. This will be the case even if the Arrangements did not comply with the laws and regulations of the UK which would have applied had those Arrangements been provided in the UK.

5. We limit the maximum amount we may have to pay you for any claims you may make against us. For all claims which do not involve death or personal injury, if we are found liable to you on any basis the maximum amount we will have to pay you is twice the value of your booking (excluding insurance premiums and amendment charges).

6. Please note, we cannot accept any liability for any damage, loss, expense or other sum(s) of any description (a) which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you or (b) which did not result from any breach of our agreement with you or other fault by ourselves or our employees. Additionally we cannot accept liability for any business losses.

7. Cancellation of your Stag or Hen Weekend

If Funk:tion changes or cancels an event that has been booked, unless you choose an alternative/tour, any monies paid by you will be returned in full. In the event of an alternative event / tour being booked at a different price to that cancelled then an appropriate refund or further payment will be made as applicable. If we are unable to provide any event or service due to any reason beyond our control, a replacement will be found. In the event of you cancelling for whatever reason a booked tour/event, then you may do so at anytime in writing provided that if the written notice is received 60 days or longer before the event day then you will forfeit the deposit paid to us. In the event of cancelling the whole reservation less than 60 days and more than 28 days before the event date, then half the tour/event is payable and in the event of cancellation 28 or fewer days before the tour/event the entire cost shall be payable. Any returned payments will be made to the group leader only. Funk:ion will not be responsible for the cancellation of any event due to force majeure.

8. All website descriptions and comments

All website descriptions and comments are made in good faith and every reasonable care is taken to ensure their accuracy. However, errors may occasionally occur. We reserve the right to make changes to and correct errors in our website descriptions and quotes at any time.

9. Funk:tion’s Complaints Policy

If you have a complaint regarding any aspect of the tour/event, you must communicate your complaint to the supplier of the service concerned at the earliest opportunity and also contact Funk:tion to let us know of your complaint. If you do not inform the supplier of the service as well as Funk:tion as soon as possible, at least within 48 hours of the complaint occurring, Funk:tion will not be responsible for the complaint. If the complaint has not been dealt with to your satisfaction before your return home, then you must make a complaint to Funk:tion in writing no less than 28 days after your return from the tour/event. If you do not comply with the complaints procedure, Funk:tion will not be responsible for your complaint.

10. Alterations to Bookings

If any alterations or additions are made to bookings after the due date of final payment, as stated in the Booking Confirmation, the individual will be charged £20 per change or addition. If you wish to change the date of your weekend there will be a charge of £75.

11. Weather conditions

As you will appreciate, we have no control over the weather. The provision of favourable weather to allow you to take part in your chosen activities does not form part of our contractual obligations to you. There is always unfortunately the risk that you may be unable to take part in weather dependent activities due to poor weather. If this occurs, you will not be entitled to change or cancel your Arrangements without paying our normal charges. You will not be entitled to the options and/or compensation set out above. We will assist you to find alternative activities or Arrangements but please bear in mind that these may only be available at an additional charge to you.

12. Legal

Sales on this web site are governed by English law and you agree to submit any dispute to the non-exclusive jurisdiction of the English courts. All orders are subject to these terms and conditions and no amendments will be accepted by us. These terms and conditions do not affect your legal rights.

These terms and conditions only cover the Funk:tion web site. Any other web sites to which you link from this site may be governed by their own terms and conditions. We accept no responsibility or liability for the content of web sites which are not under our control.

We are required by law to tell you that sales can be concluded in English only and that we do not file copies of customer contracts.
